1. Agreement

By creating an account or using ASMGUARD (the "Service"), you agree to these Terms of Service ("Terms") between you and VerlorenEnergie (KvK 95543511, "we", "us"). If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Acceptable use

ASMGUARD is a professional security testing tool. You may only use it to scan:

Domains and systems that you own, or
Domains and systems for which you have explicit, documented written permission from the owner.

You must not use the Service to:

Scan systems without authorisation.
Circumvent security controls for unlawful purposes.
Disrupt or degrade any system or network.
Violate applicable law, including the Computer Misuse Act, CFAA, or Dutch Cybercrime Act.
Resell the Service without our prior written consent.

Important

Scanning third-party targets without permission may be illegal in your jurisdiction. ASMGUARD requires ownership verification before enabling active scan modes. We cooperate fully with law enforcement investigations.

3. Account and security

You are responsible for maintaining the confidentiality of your credentials and API keys.
You must notify us immediately at security@asmguard.com if you suspect unauthorised access.
We may suspend accounts that show signs of abuse, compromise, or policy violation.

4. Trial and subscriptions

Free trial: New accounts receive a 14-day Pro trial — the full passive & monitoring suite plus AI reports on 1 target; offensive scans require a paid plan. No credit card is required. After the trial, accounts move to the free tier (Headers + SSL, 1 target).

Paid plans: Subscriptions are billed monthly or annually via Mollie. Prices are shown in EUR including VAT where applicable. Subscriptions renew automatically unless cancelled.

Cancellation: You may cancel at any time from the Billing page. Access continues until the end of the current billing period. No refunds are issued for partial periods unless required by applicable law.

Price changes: We will give 30 days' notice of price increases by email.

5. Intellectual property

The Service, including all software, reports, and UI, is owned by VerlorenEnergie. Your scan data and findings remain yours. You grant us a limited licence to process your data to provide the Service.

6. Limitation of liability

To the maximum extent permitted by law, our liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

The Service is provided for security testing purposes. We do not guarantee that it will identify every vulnerability in your systems. Security is a shared responsibility.

7. Availability and SLA

We target 99.5% monthly uptime for the web console and API. Planned maintenance will be communicated in advance. No SLA credits are available on free or trial accounts.

8. Termination

Either party may terminate at any time. We may terminate immediately for material breach (including acceptable use violations). On termination, your data will be deleted within 30 days subject to legal retention requirements.

9. Governing law and disputes

These Terms are governed by Dutch law. Disputes will be submitted to the exclusive jurisdiction of the courts in Amsterdam, the Netherlands, unless mandatory consumer protection law in your jurisdiction requires otherwise.

10. Changes to Terms

We may update these Terms and will notify registered users by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
